Bob Simon visited with several families affected by the "widow penalty," a quirk in the law under which the government says the widow or widower of a U.S. citizen can be deported if two conditions are not met before the death of the citizen spouse: (1) the couple must have been married for at least two years and (2) the green card application must have been adjudicated. The government says this holds true no matter how strong the marriage appeared to be and no matter how hard the family of the deceased fights to keep the widow in this country with her U.S. citizen children.
